What are DMCA Takedowns?

The Digital Millennium Copyright Act (DMCA) is a U.S. copyright law that Appliance Surge abides by. Under this law, we are required to remove copyrighted content that infringes on the rights of the copyright holder when notified. A DMCA Takedown request is how a copyright holder informs us of such content on our platform.

Why was my content removed?

Appliance Surge must comply with lawful, non-spurious, and validly signed DMCA takedown requests. If your content was removed due to a DMCA notice, we received a legitimate request and processed it accordingly.

Can the removed content be restored?

If you believe your content was removed in error and that it does not infringe on any copyright, you can submit a DMCA Takedown Counter-Notice. Please review our Terms Of Service for details. Appliance Surge cannot provide legal advice on whether you should submit a counter-notice, and doing so may carry legal risks.

Broadly speaking, a counter-notice may be valid if:

  • You believe your use of the content falls under fair use.

  • You believe the content is not actually copyrighted.

  • You believe the content is owned by someone other than the notifying party.

Here’s what we need from you to submit a counter-notice:

  • Identification, including specific URLs, of the material that was removed.

  • Your name, address, telephone number, and email address.

  • A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or New York County, New York, if you are outside the U.S.

  • A sworn statement under penalty of perjury that the material was removed due to a mistake or misidentification.

  • Your physical or electronic signature.
